Loyalty Program - Terms & Conditions
Membership Eligibility and Enrollment
1. Membership will be open to the public for individuals above 18 years old who meet the following criteria: - Spent €2,000 or more in the past two years. - Made 5 or more purchases in the past two years.
2. Membership is non-transferable and only valid for the individual who purchases it. Any attempt to transfer or share benefits may result in termination of the membership without refund.
Membership Fees and Payment
1. The membership fee is non-refundable once paid.
2. Membership is valid for one year from the date of payment. Upon expiration, renewal will be required to maintain access to program benefits.
3. Underdogs Gallery reserves the right to change membership fees for future periods, with at least 30 days' notice.
Membership Benefits
1. All benefits, including discounts and event access, are subject to availability. Underdogs Gallery reserves the right to adjust benefits based on business needs or external factors, with notice provided to members.
2. Every individual who purchases a membership will receive a physical membership card. This card will be issued once, regardless of how many times the member renews their membership. Please allow up to 60 days for the card to be delivered.
3. Membership benefits are activated automatically once the membership purchase is confirmed and a membership number is assigned.
Claimable Editions
1. Members are entitled to claim one edition per year.
2. Claims must be made during the membership term, and any unclaimed editions will not roll over into future terms.
3. Editions are subject to availability, and Underdogs Gallery reserves the right to offer alternative works of equivalent value if the selected edition is no longer available.
4. Editions will be shipped within 60 days after we receive your claim request.
Discounts and Promotions
1. Discounts apply only to specific products and services as outlined at the time of the offer. They cannot be combined with other promotions unless explicitly stated.
2. Discount percentages for services, including framing and installation, are subject to change based on partner availability.
Event Access and Invitations
1. Invitations to private events and studio visits are non-transferable and for the exclusive use of the member with a plus one guest, unless otherwise stated. Guest access may be permitted at the discretion of Underdogs Gallery.
2. Underdogs Gallery reserves the right to alter event dates, artist appearances, or venue details due to unforeseen circumstances. Members will be notified of any changes in advance.
Cancellation and Termination
1. Members may choose not to renew their membership at the end of their term, but no refunds will be provided for early cancellations.
2. Members may terminate their membership at any time.
3. Underdogs Gallery reserves the right to revoke membership without refund if any of the program’s terms are violated, including fraudulent use of benefits or misuse of the membership card.
4. In the event that Underdogs Gallery discontinues the loyalty program, members will receive notice at least 30 days prior.
Privacy and Data Collection
1. Any personal data collected during membership term (e.g., purchase history, contact details) will be used solely for the management of the loyalty program, including communication about upcoming events, new releases, and member-only offers.
2. Data will be handled in compliance with GDPR or other applicable privacy laws. For more details on how your data is protected, please refer to our Privacy Policy.
Force Majeure
1. Underdogs is not liable for delays or failures in performance resulting from events beyond our control, including natural disasters, wars, pandemics, technical failures, or other unforeseen circumstances. If affected by such events, we will notify you and work to resolve the situation as quickly as possible.
Changes to Terms of Service
1. We may update these Terms of Service periodically. Any significant changes will be communicated via email to registered users or posted on the website. Continued use of the website after changes are made constitutes acceptance of the updated terms.
Governing Law and Jurisdiction
2. These terms are governed by the laws of Portugal. Any disputes arising from these terms or your use of the website will be resolved in the courts of Lisbon, Portugal.
